Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Playwich LLC ("Playwich," "we," "us," or "our") governing your use of the Playwich mobile application and the website at playwich.com (together, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Playwich is an invite-only platform that helps players organize sports matches — including tennis, pickleball, golf, and other club sports — by creating and claiming match invites, forming clubs, recording results, and using an in-app coin system and fair-play ("yellow card") system to encourage reliable participation.

2. Eligibility and accounts

You must be at least 18 years old to create an account and use the Service. Playwich is not intended for, and may not be used by, anyone under 18.
Access is currently invite-only via a referral token. You are responsible for keeping your account credentials secure and for all activity under your account.
You agree to provide accurate information, including an accurate birthdate, and to keep it up to date.

3. Coins and the fair-play system

Coins are a virtual, in-app accounting tool only. Coins have no cash or monetary value, cannot be purchased with real money, cannot be redeemed, exchanged, or transferred for cash or any other item of value, and exist solely to encourage reliable commitment to matches within the Service.

We may adjust coin balances, issue yellow cards, or otherwise limit your access to invites or matches based on your participation history (for example, repeated no-shows or late withdrawals), at our reasonable discretion.
We may change the rules of the coin or fair-play system at any time, effective on notice through the App.

4. Assumption of risk — physical activity

Playwich helps you coordinate sports matches; it does not organize, supervise, or control the matches themselves. Playing sports carries inherent risk of physical injury. By using the Service to arrange or participate in a match, you voluntarily assume all risks associated with that physical activity, including risks arising from your own or other players' conduct, equipment, and the condition of courts, fields, or other facilities. You are solely responsible for assessing your own fitness to play and for following the rules and safety practices of the sport and venue.

5. User conduct

You agree not to:

Use the Service for any unlawful purpose, or to harass, threaten, or harm other users;
Misrepresent your identity, impersonate any person, or share your invite/referral token in a way that circumvents our invite-only access controls;
Attempt to manipulate coins, ratings, match results, or the fair-play system;
Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its related systems.

We may suspend or terminate accounts that violate these Terms, at our reasonable discretion, with or without notice.

6. Content and feedback

You retain ownership of content you submit (such as profile information or feedback), but you grant Playwich a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content as needed to operate and improve the Service. Feedback you submit through the App or by email may be used by us without restriction or compensation to you.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY MATCH, PLAYER, OR VENUE WILL MEET YOUR EXPECTATIONS.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLAYWICH LLC AND ITS OFFICERS, MEMBERS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, YOUR PARTICIPATION IN ANY MATCH, OR YOUR INTERACTIONS WITH OTHER USERS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT ANY LIABILITY IS NOT VALIDLY DISCLAIMED, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED FIFTY U.S. DOLLARS ($50).

9. Termination

You may stop using the Service and request account deletion at any time by emailing support@playwich.com. We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you through the App or by email. Continued use of the Service after changes take effect means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles, and without application of the United Nations Convention on Contracts for the International Sale of Goods.
